POINT OF SALE SEPTIC REQUIREMENTS
Transfer Agreement
1. NO INSPECTION REQUIRED, if these Conditions are met:
- A valid “Certificate of Compliance” for a New/Replacement System is on file with the County and has been issued within the last 5 years.
- A valid Compliance Inspection Report is on file with the County and has been issued within the last three (3) years.

2. INSPECTION REQUIRED, if Conditions in #1 are not met:
- A septic compliance inspection and report can be obtained from a licensed SSTS Inspector. If the “Septic Compliance Report” indicates a passing septic system, then the property sale or transfer may proceed as normal so long as the county has a copy of that passing report.

If a compliance inspection does not happen prior to sale, the buyer is responsible for having an inspection performed by a licensed inspector within 30 days.
IF THE REPORT INDICATES A FAILING SYSTEM:
If the replacement of a Non-Compliant system does not occur prior to closing, sufficient security in the form of an escrow agreement shall be established. The amount escrowed shall be equal to 150% of a written estimate, or 110% of the written contract price for the installation of a complying system provided by a licensed and certified installer.
In absence of an escrow account, the buyer shall be responsible for the necessary upgrading of said SSTS. A property can be sold with a Non-Compliant system "as-is".
WINTER SALES: When a property sale occurs between November 15th and April 15th, a transfer agreement is required. This includes an agreement to complete a compliance inspection by the following June 1st by a licensed inspection business.
